What constitutes TEAS plus when applying for a trademark online?

Introduction

If certain conditions are completed while you apply for trademark with the USPTO, you may be entitled to lower your filing fee. To be eligible for this reduced charge (known as “TEAS Plus”), your application must fulfil three fundamental criteria:

TEAS

All of your products and services must fit into one of the USPTO’s current class headings for “Trademark ID Manual” identifications for goods and services, and you must identify between zero and four goods/services from that class heading. If your products or services do not have a class heading (for example, “online radio programmes”), you must still file via EFS-Web (TEAS), but simply with a normal charge (unless you qualify for a different fee reduction). Application Fees

To qualify for the reduced TEAS Plus charge of $225.00 instead of the usual TEAS fee of $400.00, three requirements must be satisfied. All three conditions must be met by your trademark application.

The TEAS Plus reduced charge option is only available for online trademark applications. If you use TEAS Plus to file, you must agree to receive correspondence through email (you can also check the box to have correspondence sent by mail).

If your application fits all three of the following conditions, you may be eligible for this reduced fee:

You are submitting your first trademark application; you are not submitting a concurrent use application; and your mark consists of one or more conventional characters (i.e., letters and numerals) with no special punctuation marks.

Your application must have been submitted online (not by paper).

If you submit your application online, it will be handled by TEAS Plus. If you submitted your application on paper, it will be handled through the regular TEAS procedure.

As long as one of the following three requirements is met:

You have not previously utilised TEAS Plus to file a filing in any class (class is defined as goods or services); the mark has never been used on or in connection with any goods or services; and/or the mark has never been registered elsewhere in the world (even if solely for specific goods/services).

You must consent to receive e-mail contact from the USPTO.

This is a prerequisite because all online papers are made available in PDF format and emailed to the applicant. You can modify this setting after you’ve filed your application, but you must do so before you begin submitting your trademark application online.

If you do not agree to receive email contact, you must submit via EFS-Web, which is not an option with TEAS Plus, so keep this in mind when determining where and how to file your trademark application.

The reduced charge for online applications is $275 for all classes. If you use TEAS Plus to file, you may be eligible for the reduced charge if your application fits one of the following two criteria: You are submitting your first trademark application; or You have not submitted a concurrent usage application. If you have previously filed a filing in any class using the TEAS Plus system; the mark has been used on or in connection with any products or services; and/or the mark has been registered anyplace in the globe, your application will be handled using TEAS Plus.
