Subclass 482 Versus Subclass 186: What’s The Difference?

Search for a work visa finishes when the needy come across visa subclass 482 and 186. Both subclass 482 and subclass 186 are employer-sponsored visas. The main difference between these two is visa subclass 482 is a temporary visa while visa subclass 186 is a permanent visa.

The employer sponsoring or nominating the worker must operate a standard business and engage in occupations listed on an eligible skill list.

Let’s have a look at both of these visas- 

Temporary Skill Shortage Visa Subclass 482

Eligibility

To comply with the 482 visa requirements of eligibility, an applicant must – 

  • Have experience working for a minimum of two years in his field.
  • Have completed skill assessment 
  • Have proof of English proficiency
  • Have met health and character requirements
  • Have a bridging visa subclass 010, 020, or 030 ( if applying from inside Australia)
  • Fulfil the 482 visa conditions attached to the visa application.

However, no age restriction is there for a 482 visa. The employer must operate a business in Australia and have a standard business sponsorship. To nominate an employee, he must submit a valid employment contract. Under the short-term stream, the applicant must hold a genuine temporary entrant (GTE).

Streams Of Visa Subclass 482

TSS 482 visa has the following stream in which a worker can apply –

  1. Short-term stream- The occupation selected must be on the short-term skilled occupation list (STSOL).
  2. Medium-term stream- The occupation selected must be on the medium and long-term strategic skills list ( MLTSSL).
  3. Labour agreement stream- The employer must have a labour agreement with the applicant.

Processing Time 

The processing time of temporary skill shortage visa subclass 482 is 75% of applications in 38-45 days and 90% of applications in 74-94 days. The time may vary case-to-case as per the individual circumstances. It excludes skill assessment and employer approval time.

Employer-Sponsored Visa 186

Employer nomination scheme subclass 186 allows a worker whom the employer nominates to work and stay in Australia permanently.  Visa 186 permits an aspirant to work or study in Australia and travel to and from Australia for five years.

Eligibility 

To meet the eligibility criteria for employer-sponsored visa 186, an applicant-

  • Must have proof of skills required for the job (skill assessment)
  • Must have nomination by an Australian employer
  • Must be of age less than 45 years (unless exempted)
  • Must have experience of at least three years in the related field
  • Must have a certificate of good health and character
  • Must have a certificate of competency in English.

The applicant must sign an Australian value statement which ensures the Australian government that he will follow the laws and regulations of the country.

Streams Of Visa 186

A subclass 186 visa has the following streams-

  1. Direct entry stream- the business must be on the eligible skilled occupations list.  
  2. Temporary residence transition stream- The worker applying for a 186 visa must hold a visa subclass 457, TSS, bridging visa A, B, or C. The employer nominates the worker to work full-time. The employer has to offer the same position in the same occupation as in subclass 482 and 457.
  3. Labour agreement stream- In this stream, an applicant who is or will work with the employer under a labour agreement. 

Processing Time 

The 186 visa processing time is 75% of applications in 11 months and 90% of applications in 16 months.  To avoid delay in a visa application, the applicant must ensure he has complied with all the visa subclass 186 requirements. The documents attached to the application must be duly updated and signed. The time of application processing excludes skill assessment and employer approval time.

Conclusion 

The conclusion is that both the visas, i.e. temporary skill shortage visa subclass 482 and employer nomination scheme subclass 186, are employer-sponsored. The worker applying must fulfil skill assessment and English competency, health and character requirements to qualify for eligibility criteria.

The occupations in the short-term skilled occupation list (STSOL) apply to the short-term stream in TSS, but STSOL does not apply to any of the streams of employer-sponsored visa 186.

There is no age restriction on the 482 visas, but the applicant must not be more than 45 years (unless exempted) in the 186 visas.  The processing time for visa 482 is approximately 38 to 94 days, while the time required for visa 186 is some months.

But subclass 482 visa is a temporary visa, while subclass 186 visa is a permanent visa. TSS 482 visa requires work experience of two years, but the work experience requirement in employer-sponsored visa 186 is three years.
