What Are The Qualifications Required to become a Patent Agent?

They must be an Indian Citizen.

  • He should be older than 21 years.
  • The candidate must be graduated from a central board-certified institute in the field of engineering, science, and technology. Even a final-year student can apply for the patent agent exam, as long as he or she can produce all the mark sheets within 2 months from the announcement of the examination.
  • He should pass the qualifying exam prescribed to become an Indian Patent Agent.

What Consists in the Indian Patent Agent Examination

If the candidate can meet all the qualifications that have been mentioned above, only then one can apply for Indian Patent Agent Examination, the qualifications have been clearly stated in act 126 of the Indian Patent Act.

The candidates are Given independence when it comes to choosing the exam center at their convenience. However, the Exam is only conducted in 5 major cities in India. They are respectively, Mumbai, Delhi, Nagpur, Chennai, and, Kolkata. The examination is held in the cycle of once every single year. Here are the things consistent within the examination.

Paper I (100 Marks)

Paper I is consist of both objective and descriptive questions that are solely based on all the patent act rules and regulations.

Paper II (100 Marks)

Paper II consists of questions that are related to the drafting and interpretation of patent specifications as well as descriptive answers from the patent act and PCT.

In order to qualify for the test, the candidate must score a minimum number of 50 marks on each paper. To do that, the candidate is recommended to follow all the norms and regulations that are consistent in the Indian patent act, and the rules, practices, and procedures that are required in patenting.

Once a Candidate qualifies the paper I and Paper II, he or she shall be subjected to viva. Where they will be given an oral test to evaluate their knowledge in the practical field. Here the candidate must secure 60% marks out of the 50 marks viva test.

Altogether, the Candidate is required to have a total aggregate number of 60% marks in all the examinations to qualify for the post of Indian Patent Agent.
